TOAV water acquisition update (October 22, 2019)

WATER ACQUISITION UPDATE: After many years of community efforts to acquire the water system, the Town of Apple Valley is pleased to share that trial will begin with opening statements tomorrow, Wednesday, October 23.

As a bench trial, the case will be heard by a judge, Superior Court Judge Donald Alvarez, and not by a jury. The judge will ultimately decide whether the Town has the right to acquire the Liberty Utilities water system by eminent domain.

The Town Council is pleased to see the commencement of this long-awaited trial and wishes to remind Apple Valley residents that the public is welcome to attend the court trial in Department S23 in the San Bernardino Justice Center at 247 W. 3rd Street, San Bernardino.

Following the conclusion of the right-to-take phase, if the judge finds in favor of the Town, there will be a valuation phase where a jury will be selected to determine the value of the water system. The trial date for the valuation phase will be set at a later time.

Court begins each day at 10 a.m. Attendees are encouraged to arrive at least 15 minutes early. Address location is Department S23 in the San Bernardino Justice Center at 247 W. 3rd Street, San Bernardino.
