Councilman Emick,

I spoke this morning with Randall Andrus with the McCrea Group. Randall mentioned that he had spoken with you and that you asked that he contact me regarding water well issues between the McCrea Group and Apple Valley Ranchos Water Company (AVR). Randall indicated that it is the groups desire to be helpful to the Town in its efforts to acquire AVR and so he was simply looking or information at this point. According to Randall, McCrea Group owns the underlying property that supports one of AVR’s wells in the vicinity of Sitting Bull Road. Randall was unsure whether the water pumped from the site is McCrea owned water rights leased by Ranchos, or whether it is just a well site on McCrea land where AVR pumps its own water right, but the well site is under a lease that reportedly expires sometime in 2015. By letter, Ranchos has indicated its desire to purchase the well site from McCrea and to process a parcel map through the Town to separate the well site from the larger McCrea land holdings. After some discussion about water rights, adjudication, leasing of water rights, acquisition and system valuation and other details regarding the current demeanor of AVR to the Town’s proposal to acquire the system, Randall indicated to that they would make no immediate changes to the current leasing program and that he would contact me if anything should change going forward. Bottom line is, he will recommend to the partners that they not transfer the ownership at this time and that they continue to lease the well site as they have been some quite a number of years now.
