Request for public records (March 27, 2017)

Bonds being considered for the purchase of Liberty Utilities that are not for a period of 30 years

Deputy Town Clerk
Town of Apple Valley

Apple Valley, CA 92307

Re: Request for Public Records

At the March 14th, 2017, Town Council meeting, Mayor Scott Nassif implied that there may now be bonding options for the eminent domain purchase of Liberty Utilities other than those from April 28, 2015, which you provided me on October 11, 2016. I also have it on good authority that Barb Stanton is privately making the same implication.

Therefore pursuant to California Government Code section 6250 et seq., the California Public Records Act (PRA), I am requesting the following public records:

  • All bonds being considered for the purchase of Liberty Utilities that are not for a period of 30 years, including the term(s) and currently-quoted interest rates.

If records are available in both an electronic format and a hard-copy format, please provide only the electronic records. You can email the electronic records to me. Please provide me with the cost of providing the records.

Should you withhold responsive records, please justify the withholding of the record in writing with a demonstration as to why the record is exempt from disclosure. (Gov. Code § 6255, subd. (a).) Please also provide the name and title of whomever was responsible for the denial. (Gov. Code § 6253, subd. (d).)

I am looking forward to your determination within 10 days as to whether you possess disclosable public records that are responsive to this request.

Sincerely,

Greg Raven is Co-Chair of Apple Valley Citizens for Government Accountability, and is concerned about quality of life issues.

See the Town’s response that they have no such records.
